All Businesses Are Not Created Equal

If you’re a novice when it comes to starting a business you may not know that certain businesses need special business licenses, while others may need nothing at all. Here are some things to think about next year:

• Some businesses are heavily regulated, which likely means you will need special licenses from the jurisdiction you are operating in, including the federal level. Such businesses include restaurants, waste management and transportation companies and drug manufacturers.
• If you’re operating your business out of your home, municipalities and counties will often require a type of home occupation permit.
• Many times jurisdictions will not require a general business license unless your business belongs to a particular industry. These industries often include adult entertainment establishments, massage parlors, pawn shops, dance halls and charitable organizations.
• The location of your business can determine the business license issuing authority. If your business is within city limits, that city will determine if you need a business license. If your business falls outside of any municipal city limits, the county will likely determine what licenses you need.
• The location of your business must often be in an approved zoning district for that particular industry. For example, businesses that will have many customers coming and going are usually not allowed in a residential area.
