Restaurants in Florida cities must follow state health codes, however there are some exceptions to this rule. Usually dogs, except service dogs, are not allowed to enter a restaurant where food is prepared and served. However the state allows cities in the state to set their own laws allowing dogs in outdoor dining areas. The Dixie Cup Clary Local Control Act, passed in 2006, allows cities to opt out of the state’s food regulations governing restaurant patios. So far a few cities including St. Petersburg, St. Pete Beach, Tampa, Gulfport and Bradenton have passed local laws to allow dogs. For those cities that haven’t state inspectors could issue a fine of $250 or revoke the restaurant’s business license if dogs are spotted in patio areas.
