A scrap yard in Flint, Michigan is asking city officials to curb their decision to temporarily suspend the company’s business license.
Spooner Metal filed the temporary injunction on the grounds that the city didn’t follow due process when they voted to suspend the yard’s junk dealer license for 60 days, according to the Flint Journal.
The business has been accused of selling stolen goods that belonged to the city.
Spooner Metals submitted a court document to city officials, stating: “This suspension would prohibit Spooner from doing business under its city license if the junction does not issue, causing irreparable injury to Spooner’s business.”
The junk yard were ordered to attend a special hearing earlier this month with J&S Salvage, who was also accused of selling stolen goods.
Despite the company returning the goods to the city, they were found guilty.
The offence of being in possession stolen property is made up of two parts in the US.
First, a person must have property that was gained by theft, fraud or any other crime. Second, that person must have knowledge that the property was stolen.
